BVUTE THREATENS TO ASK FOR MORE MONEY FROM CROWHILL STAND OWNERS !!!! - PUBLISHED JAN 15 2015
BANKER Ozias Bvute and businessman Cephas Msipa have ended their row over the upmarket Crowhill development in Harare’s Borrowdale area after reaching an out of court settlement Wednesday.
Bvute had sought legal relief, accusing Msipa (son to former Midlands governor Cephas Msipa) of trying to illegally wrest Crowhill Farm from him.
Msipa also faced fraud allegations after allegedly subdividing the property and selling off the stands through various estate agents without Bvute’s knowledge.
According to documents before the court Msipa claimed to have serviced 300 stands at the farm and handed them over to Bvute’s company.
But when the former Air Zimbabwe chairman conducted a site visit, he discovered that Msipa had actually developed some 4,000 stands, sparking the row between the pair.
However, Bvute’s attorneys confirmed an out of court settlement had been reached at the High Court before Justice Bhunu.
“We had filed a consent order which had been negotiated between the parties,” said Bvute’s lawyer, Tinashe Tanyanyiwa of Manase and Manase Legal Practitioners.
“The judge called us into chambers and we were able to have the judge then confirm the consent order as had been discussed by the parties.
“The consent order acknowledges that Crowhill Farm is owned by Mr Ozias Bvute and that Crowhill (Pvt) Ltd (registered by Mr Cephas Msipa) will cease all projects on the land which will then be taken over by Crowhill Farm; that is Mr Bvute and his management team.”
He added: “It means that both parties are committed to ensuring the full development of the area because the area is an upmarket area and there needs to be rapid development.
“My client (Bvute) is committed to fully developing the area. It is a welcome victory not only for our client but for everyone who has a stake in Crowhill Estates.”
Individuals who bought stands in the area have however been warned they should expect to pay more because they had acquired a “defective title”.
“Everyone holding title deeds acquired them through a flawed process and thus acquired defective title,” said Tanyanyiwa.
“However, my client has resolved to be magnanimous and he is inviting everyone with an interest in the land by virtue of having these title deeds to work with us to rectify this matter and gain proper legal title.

“His vision is that this place should be commensurate with areas in the vicinity. I believe that anyone who is serious about investing in Crowhill will see that as a welcome development.
“So people should not worry about anything. The owner is there and is going to make sure that this place is developed as he wants it to be and as everyone wants it to be.”
CROWHILL LAND SAGA TAKES NEW TWIST - MSIPA KICKED OUT - 15 JANUARY 2015
High Court on Wednesday declared former Air Zimbabwe board chairperson Ozias Bvute the lawful owner of Crowhill Farm (Pvt)(LTD) in Borrowdale after an agreement was reached by consent.
This follows an ownership wrangle that had erupted over the property between Bvute, CrowHill Farms and Cephas Msipa (Jnr)
The order read: “It is ordered by consent that the applicant Bvute (Crowhill Farm Pvt Ltd) is the sole owner of the immovable property known as Chirika Extension of Borrowdale Estate measuring 121,4029 hectares and Lot J of Borrowdale Estate measuring 724,0475 hectares held under the deed transfer 1214/86 which property has been subdivided into 4 207 certificates of registered title denoted as stand numbers 1 to 4 207. All certificates of registered title currently in the name of the applicant are the applicant’s property,”
The first and second respondent (Crowhill Farms and Cephas Msipa) were ordered to “immediately return, upon the granting of the order all certificates of registered title in the name of the applicant.
Under the order, Crowhill Farms and Msipa, their employees, agents, representatives and anyone claiming and exercising any rights over Chirika Extension and Lot J Estates to immediately stop doing so.
The High Court order also ordered Crowhill Farms and Msipa to immediately surrender Bvute’s property and all developmental projects and immediately return to the applicant the Master title deed, the original copy of Crowhill Properties Owners Association constitution among other issues.
However, Bvute, Msipa and Crowhill Farms will be liable for all Zimbabwe Revenue Authority tax charges, municipal rates and charges.
Msipa, according to the court has never been part of Crowhill Farm (Pvt) Ltd but allegedly became involved with the company after he approached Bvute claiming that he could subdivide the farm as he had done at his Charlotte Brook Development.
The court documents say that the respondents subdivided some of the land and remitted 300 stands to Bvute’s company under the pretext that they were the only stands that had been subdivided.
According to the court, a site visit showed that Msipa had actually subdivided 4 000 stands and concerted efforts to stop his actions failed.
Upon receiving title deeds to facilitate the subdivision of the farm, it is alleged that Msipa handed over the title deeds to his sister-in-law’s law firm, BM Msipa and Associates, who have been assisting him to ‘perpetrate this fraud against the applicant company’.
Msipa allegedly doled out stands to several politicians, allegedly to buy favours.
To facilitate the alleged theft of the property, Msipa is said to have clandestinely registered a company called Crowhill (Pvt) Ltd as a subsidiary of Bvute’s Crowhill Farm (Pvt) Ltd.
Bvute who was represented by Thembinkosi Magwaliba also cited Themba Hlongwane, Registrar of Deeds and Sheriff of Zimbabwe as other respondents

MARCH 2014 - STILL NO PROGRESS ON SERVICING IN CHARLOTTE BROOKE & CROWHILL
Well another year, another month, still no servicing of any kind of the stands in Charlotte Brooke, by Zanu PF crony Cephas Mandlenkosi Msipa, instead with the help of Chombo he is busy stealing more land and now selling stands (unserviced) with a view to encroach Glern Lorne
Its now 10 years since this deceitfull man sold stands in Charlotte Brooke, yes 10 years of no Progress. No road, no water, no electricity, the whole place is just a bush and muppets at Goromonzi Council are happy to charge rentals in an area they provide zero service

Hey,I bumped into your blog and i think its a good idea. Here is something that you can write about:
Just this week,i was robbed by the Goromonzi RDC. I was made to pay $1189 as rates from 2005 plus $521 for plan submission. I feel they have no right to charge us all this since they are not providing any service in Charlotte Brooke. I had no choice but to pay since I wanted my building plans to be approved.
Is this happening to everyone who goes there to submit plans?
